Affirming an order denying a petition to reduce to a misdemeanor a conviction for felony theft from an elder because the Safe Neighborhoods and Schools Act because although the defendant claimed he stole less than $900 from his grandmother the restitution ordered was for nearly twice that amount, more than the $950 or less required by the Act, and he failed to meet his burden in establishing eligibility.
