California Court of Appeal
P. v. Balov, 073018
Affirming the denial of a motion to suppress the results of a blood test that established that a driver was drunk who submitted to the test after a police officer advised him that per California law he was required to submit to a breath or blood test but without advising him as to the statutory consequences of refusing a test, which the driver claimed was coercive, but which did not change the fact that implied consent is triggered by driving on California roads.
