Weiler v. Marcus & Millichap Real Estate Investment Services, Inc., 053953

Holding that a real estate investment services company that allegedly lost millions for the plaintiff, giving rise to claims for breach of fiduciary duty, negligence, and elder abuse, must either pay the plaintiff's costs in arbitration or waive their contractual right to arbitrate and be tried in superior court because the interest in justice outweighed the great deference normally extended to arbitration agreements.
