California Court of Appeal

P. v. Jackson, 065757

Reversing the judgment of competency and sentence in the case of a mildly mentally retarded man accused of lewd contact with a minor who repeatedly was found incompetent, but was once found competent when hospital staff drilled him until he could answer simple, concrete questions about the judicial system, but later investigation revealed that he continued to be incapable of understanding the charges against him or the meaning of his plea.
