Granting a petition and directing the issuance of a peremptory writ of mandate directing the respondent superior court to vacate an order granting a motion to disqualify a judge in a case that was refiled following several pretrial rulings against the People of the State of California and the assignment of the newly filed case to the same judge because the action was clearly a mere continuation of the first and thusly peremptory challenges were premature.
