Garcia v. Mercedes Benz USA, LLC, 279897

Affirming the denial of attorney fees but modifying the judgment to award costs in the case of a brand new Mercedes Benz whose engine died and the owner was reimbursed for all but the dealer add-ons, which became the subject of a suit for breach of implied warranty of merchantability under the Song-Beverly Consumer Warranty Act that resulted in a confidential settlement, after which the buyer moved for attorney fees and costs because the buyer obtained net monetary recovery by virtue of the settlement.
