Affirming the trial court's award to the plaintiff of preoffer attorney fees and costs in the case of a professional model whose likeness was used to advertise a bar without her consent because the court found the plaintiff had prevailed in misappropriation claims but had not achieved a more favorable judgment under the Code of Civil Procedure and the court did not err in imposing penalties for not accepting the defendant's earlier offer of settlement.
