California Court of Appeal

P. v. Franklin, 071453

Affirming a conviction for premeditated and deliberate attempted murder because although the defendant claimed that the jury hadn't been encouraged enough to consider how he had been provoked the court found that he failed to establish prejudice flowing from any such error, but also remanding for resentencing due to recent legislative changes in the sentencing scheme for firearm enhancements.
