California Court of Appeal
De Havilland v. FX Networks, LLC, 285629
Reversing a trial court denial of a television station's motion to strike the complaint in a case involving a golden-age movie star, depicted in the show Feud, who thought that her portrayal in the show violated her rights because the lower court's reasoning that the show had attempted to be realistic meant that it was not transformative and therefore not entitled to First Amendment protection, but the notion that the truth would not be protected by the First Amendment was eloquently rebutted.
