California Court of Appeal

Austin v. Medicis, 277546

Affirming the determination that imprisonment on a criminal charge which tolls the statute of limitations only occurs when a person is serving a term of imprisonment in a state prison and the trial court's grant of a demurrer to the defense in a breach of contract suit whose cause of action arose while the plaintiff was in pretrial custody, an incarceration which they found does not toll statutes of limitations.
