Affirming a trial court order denying the petition to compel arbitration as to negligence and elder abuse claims brought by the deceased's survivor against an elder care facility because the wrongful death claim was not subject to arbitration and the court properly acted within its discretion to deny the enforcement of the arbitration agreement as to the remaining claims to avoid the possibility of inconsistent judgments.
