Rojas v. HSBC Card Services Inc., 071442

Reversing the trial court's grant of summary judgment to the defendant HSBC, accused of recording confidential telephone conversations without the knowledge or consent of the other party because, although HSBC claimed it did not intend to record the private conversations had with the plaintiff when family and friends called her on company phones for personal discussions, they did not meet their burden of establishing that they did not have knowledge to a substantial certainty that uses of this sort would result in recording confidential communications.
