California Court of Appeal
Gonzalez v. Lew, 271312
Affirming that a joint offer of settlement in the wrongful death case of two people that died in a fire at a rented home, offered to the owners of the building by the defendants, was not an invalid offer that would trigger the Code of Civil Procedure's cost-shifting statute designed to punish parties that refuse to offer reasonable settlements because under the specific facts of the case the inability to evaluate the claims separately on account of the joint offer did not impact the offer's validity.
