Reversing the dismissal of a qui tam action in which a former employee claimed that his supervisor had made false statements in an incident report relating to a workers' compensation claim, alleging a violation of the Insurance Frauds Prevention Act because although the court correctly held that his claim was not barred by the workers' compensation exclusivity rule, they erroneously found that the suit was barred by the litigation privilege, which does not extend to such a claim.
