California Court of Appeal

California American Water Company v. Marina Coast Water District, 146166

Affirming a judgment requiring the appellant marina to pay attorney fees incurred by a water company and county water resources agency after they successfully argued that contracts between the parties were void, rejecting the marina's argument that attorney fees are only authorized in cases involving an action on a contract and holding that since the underlying contract was void they had no statutory entitlement, because the action to void a contract was a qualifying action on a contract.
