California Court of Appeal

Department of Alcoholic Beverage Control v. Alcoholic Beverage Control Appeals Board, 083619

Annuling the decision of the Alcoholic Beverage Control Appeals board that an in-store identification by a minor decoy who purchased a can of Coors Light in a CVS of the clerk who sold them the beer from 10 feet away did not constitute a face-to-face identification as required by California law because the distance was a reasonable proximity from which to make an accurate identification.
