Granting a petition for writ of mandate in the case of a quiet title action in which neither party appeared at the first court date and the trial court, on its own motion, set a hearing to dismiss and subsequently denied the plaintiff's motion for reconsideration and granting judgment on the pleadings against them without stating reasons for its action because the trial court cannot arbitrarily deny a litigant the right to appeal an adverse judgment, as they had done here when the plaintiff refused a timely request by the petitioner to preserve the record for appeal.
