Dryden Oaks, LLC v. San Diego County Regional Airport Authority, 069161

Affirming the entry of summary judgment in favor of the defense in an inverse condemnation case where a man who successfully received permits to build on land near an airport that a County authority opposed was unable to obtain new permits when the initial ones expired because, in the intervening period, the County had adopted a land use plan that limited the use in such a manner as to prevent the permits from being issued because the trial court properly found that no taking had occurred and, to the extent that there was any arguable claim, it would have been against the City issuing the permits and not the County authority.
