Affirming the conviction of a man for assault in a case where the trial court decided that a jury committed misconduct by discussing the defendant's choice not to testify, but the court determined that this misconduct was not prejudicial and the appeals court held that since the trial court did not instruct the jury not to consider the defendant's decision not to testify no misconduct occurred.
