Reversing a superior court decision not to grant a motion to dismiss an indictment on the basis of the deputy district attorney's error in excusing a juror for hardship which violated the grand jury's independence and rendered it improperly constituted because the deputy district attorney lacked the authority to do so an the act was not harmless.
