Surfrider Foundation v. Martins Beach LLC, 144268
When developers bought some beach and closed off access to the public an organization representing surfers complained that they lacked the permits required to do so and the court issued an injunction requiring public access; the appeals court agreed that the appellant's conduct was development, that the injunction was not a government taking, that constitutional challenge to the permitting requirement was not ripe, and affirming the award of attorney's fees.
