In a case arising from a dispute in a gated community between the neighborhood association and a family over their refusal to comply with a policy requiring them to muzzle their dogs the court overturned the dismissal of the mother's claims under the vexatious litigant defense because she had never been found to be a vexatious litigant by the courts, but the dismissal of her son's claims were upheld since he had previously been declared a vexatious litigant.
