Jenkins v. Hutton, 16-1116
In a 28 U.S.C. section 2254 petition for writ of habeas corpus relief from murder conviction and death sentence, the Sixth Circuit's decision is reversed and the petition is granted where the Sixth Circuit was wrong to hold that it could review petitioner's claim under the miscarriage of justice exception to procedural default.
