California Court of Appeal
People v. Marquez, 070609
On remand, a minor's sentence of life without the possibility of parole (LWOP) for conviction of special circumstance murder is affirmed over defendant's contentions that the trial court misapplied the Miller v. Alabama (2012) 567 U.S. 460 criteria and that his sentence constitutes cruel and unusual punishment under the Eighth Amendment, where the suitability hearing provisions of Proposition 57 are not retroactive.
