Nautilus, Inc. v. Yang, 051956

In a suit seeking damages stemming from the fraudulent conveyance of real estate under the Uniform Fraudulent Transfer Act (UFTA), Civ. Code section 3439 et seq, brought against the property owners and lenders who funded a reverse mortgage on the property, the trial court's judgment that the lenders cannot be liable to plaintiff is affirmed where, although the trial court misapplied the burden of proof in connection with the good faith defense, given the facts of the case even under the correct burden of proof and legal principles, the good faith defense was established.
