California Court of Appeal

In re B.M., 277076

In a minor's appeal of the juvenile court's orders declaring her a ward of the court and sustaining a petition charging that appellant committed a felony assault with a deadly weapon in violation of Penal Code section 245(a)(1), the orders are affirmed where the butter knife used by minor was a deadly weapon because an assault with a deadly weapon is complete when the defendant, with the requisite intent, uses an object in a manner which is capable of producing great bodily injury upon the victim.
