Conviction for driving under the influence of alcohol is affirmed. The Court held that Vehicle Code section 41403 does not independently authorize a defendant to move to strike his earlier felony conviction for driving under the influence by arguing ineffective assistance of counsel, in light of Garcia v. Superior Court, 14 Cal.4th 953 (1997) and the statute's text.
