California Court of Appeal
People v. Tovar, 145498
Sentence for conviction of first degree murder and conspiracy to commit murder based on defendant's participation in the 2010 killing of a teenage football player is affirmed over defendant's contention that insufficient evidence supports the jury's finding that he committed the conspiracy offense 'for the benefit of, at the direction of, or in association with [a] criminal street gang, with the specific intent to promote, further, or assist in any criminal conduct by gang members,' Pen. Code section 186.22(b), the gang enhancement.
