California Court of Appeal

Quiles v. Parent, 054353

In a defendant's appeal relating solely to the awards of attorney fees and costs that followed the initial entry of judgment in an underlying wage and hour class action, in which defendant did not satisfy or bond the awards of costs and attorney fees, defendant's writ of supersedeas, clarifying that the remainder of the judgment is automatically stayed pending appeal, is granted where the attorney fees and costs awarded to Quiles qualify as 'costs' under Code Civ. Proc. section 1021 et seq. and therefore no bond is required.
