California Court of Appeal
People v. Russell, 064121
Convictions of attempted murder, Pen. Code sections 664 and 187, aggravated mayhem, section 205, torture, section 206, and assault with a deadly weapon, section 245(a)(1), are affirmed over defendant's contentions that there was no unanimous oral declaration of a guilty jury verdict, the trial court erred in denying his motion to exclude statements he made during a police interview before he was advised of his Miranda rights, the trial court violated his constitutional due process rights by failing to disclose a juror's identifying information, and by not subpoenaing that juror to testify regarding juror misconduct disclosed to trial counsel.
