California Court of Appeal

In re Cristian S., 043104

In an appeal involving a negotiated agreement in a Welfare and Institutions Code section 602 proceeding, in which the minor admitted one count of conduct that if committed by an adult would constitute lewd or lascivious conduct on a child under the age of 14, Pen. Code section 288(a), and two other counts were dismissed, the restitution order, imposed by a different judge than the one who handled both the jurisdiction and disposition hearings, is affirmed where the rights defined in People v. Arbuckle (1978) 22 Cal.3d 749 do not apply to victim restitution hearings in juvenile court.
