People v. Vandiver, 065899

In the People's appeal of the trial court's grant of a Proposition 47 petition for resentencing of a felony to a misdemeanor for receiving stolen property based on her possession of blank checks petitioner knew had been stolen, the judgment is affirmed where the People did not carry their burden of affirmatively showing the trial court mistakenly applied the fair market value test or concluded without substantial evidence the value of the stolen checks in this case did not exceed $950.
