People v. Lowery, 042551

In a Proposition 47 petition for resentencing concerning the meaning of the term 'value' in Penal Code section 473(b), which makes check forgery a misdemeanor if the value of the check does not exceed $950, the denial of the petition is reversed and remanded for further proceedings where the trial court erroneously ruled that the value of the check was equal to its written value as a matter of law.
