In a construction defect case involving the notice and time requirements of the Right to Repair Act, Civil Code section 895 et seq., the homeowner-plaintiff's petition for writ of mandate is granted, vacating the trial court's order staying proceedings pending petitioner's compliance with the act, where petitioner's compliance with the act was relieved by virtue of builder-defendant's failure to timely acknowledge receipt of petitioner's notice of a claim.
