In a petition for writ of habeas corpus relief from conviction of armed robbery of a loan office, the petition is granted and conviction vacated where under the recently amended statute, declarations from petitioner's codefendant and two other men, sworn under penalty of perjury that petitioner was not at the loan office and had nothing to do with the robbery, qualify as 'new evidence' and petitioner meets the new standard for habeas corpus relief.
