In a petition by a nonminor dependent of the juvenile court, arising out of a hearing held after real party in interest Alameda County Social Services Agency recommended that petitioner's dependency be dismissed and sought to have petitioner's psychotherapist testify as to confidential communications, the trial court's ruling petitioner had waived the psychotherapist-patient privilege by putting her mental state at issue is vacated and the petition is granted where petitioner did not tender the issue of her mental condition in the litigation.
