People v. Munguia, 070141

Conviction of first degree burglary is affirmed where: 1) the conviction is supported by substantial evidence; 2) the occupied burglary enhancement applies if there is a person other than an accomplice present at any time prior to the perpetrator's final departure from the residence; 3) no prejudice resulted from the admission of defendant’s prior burglary conviction; and 4) no instructional error was committed.
