California Court of Appeal

People v. Byers, 051068

Conviction by guilty plea to possession of cocaine for sale, Health & Saf. Code section 11351, and misdemeanor possession of nitrous oxide for the purpose of intoxication, section 381b, is affirmed over defendant's claim that the where: 1) substantial evidence supported the trial court's finding that defendant's housemate's consent to search their shared home was voluntary; 2) although the trial court abused its discretion by excluding evidence on whether the officers complied with the knock-notice requirement, the error was harmless because the appropriate remedy for a knock-notice violation here was not the suppression of the seized evidence; and 3) there was no Pitchess error.
