Stand Up for California! v. State of California, 069302

In a suit challenging the Governor's authority to concur in the decision of the Secretary of the U.S. Department of the Interior to take land in Madera County into trust for defendant North Fork Rancheria of Mono Indians for the purpose of operating a casino for class III gaming, the trial court's judgment in favor of the state defendants is reversed and remanded where: 1) the Governor's concurrence is invalid under the facts alleged in this case; and 2) plaintiffs have stated a cause of action for a writ of mandate to set the concurrence aside on the ground that it is unsupported by legal authority.
