In a case in which defendant was initially granted a mistrial on a second degree murder count, but on retrial was convicted of second degree murder, the conviction is reversed where: 1) the trial court erred during his retrial by not informing the jury that he had been convicted in the first trial of gross vehicular manslaughter while intoxicated; and 2) the error requires reversal of his second degree murder conviction.
