McNair v. City and County of San Francisco, 138952

In an action brought by a plaintiff who lost his job as a bus driver when his commercial driver's license was temporarily revoked as a result of a letter written by plaintiff's doctor disclosing her patient's confidential medical history and health conditions to the California Department of Motor Vehicles (DMV) against plaintiff's wishes due to public safety concerns, alleging injury due to breach of his medical privacy rights, the trial court's grant of summary adjudication on his intentional tort cause of action and nonsuit on his breach of contract claim are affirmed where both of plaintiff's claims were barred by the litigation privilege.
