California Court of Appeal

Doe v. Regents of the University of California, 068901

In an action arising out of university disciplinary action against a student for sexual assault, the trial court's grant of the student's petition for writ of mandate, requiring the university to set aside their findings and the sanctions issued against the student, is reversed where: 1) substantial evidence supports the Panel's decision and findings; 2) student was provided with notice of his alleged violation, informed regarding the basis of that violation, and given the opportunity to put forth his defense; and 3) the university's sanctioning of the student was not an abuse of discretion.
