Syngenta Seeds, Inc. v. County of Kauai, 14-16833
In an action challenging Kauai County's Ordinance 960's pesticide provisions, which regulate pesticides and genetically engineered plants, the District Court's judgment is affirmed where: 1) the Hawaii Pesticides Law impliedly preempted the ordinance; and 2) the court did not err in its denial of defendants' motion to certify the implied preemption question to the Hawaii Supreme Court, as it was unnecessary because the State's test forimplied state preemption was well-defined.
