California Court of Appeal

In re Calvin S., 265382

In a 14-year-old minor's appeal of the juvenile court order declaring him a ward of the court pursuant to Welfare and Institutions Code section 602 and committing him to the Department of Corrections and Rehabilitation, Division of Juvenile Facilities (DJF), after sustaining allegations that he committed assault with a firearm and assault with intent to commit a sexual offense, the order is reversed and remanded for a new hearing where the juvenile court abused its discretion in committing minor to the DJF and the court should have stayed the term of commitment for assault with intent to commit a sexual offense.
