In a consumer protection action, arising from plaintiff's purchase of a used 2007 BMW car, the trial court's grant of plaintiff's motion for a new trial as to defendant Wells Fargo, the assignee of plaintiff's retail installment sales contract, is reversed where the trial court correctly ruled pretrial that plaintiff could not comment to the jury regarding defendant Wells Fargo's tender under the attorney fees and cost provision of the Automobile Sales Financing Act, Civil Code section 2983.4.
