California Court of Appeal

People v. Asbury, 255953

In a case in which defendant was convicted of murdering her ex-boyfriend, involving a petition for writ of habeas corpus and a direct appeal: 1) defendant's petition for writ of habeas corpus relief is denied; but 2) her conviction is reversed on the ground that the trial court erred by refusing to instruct the jury regarding voluntary manslaughter under a heat of passion theory.
