California Court of Appeal

In re N.C., 146637

In a case involving conviction of a minor defendant (a victim of human trafficking) with prostitution under Penal Code section 647(b), the trial court's denial of defendant's motion to exclude all evidence sought to be introduced by the district attorney to show that she solicited acts of prostitution in violation of section 647(b), is reversed where Evidence Code section 1161 does apply in juvenile proceedings because the trial court's acceptance of the prosecutor's interpretation of that statute would virtually wipe out a significant protection afforded victims of human trafficking by the Californians Against Sexual Exploitation Act (CASE Act).
