City of Bakersfield v. West Park Home Owners Assn. and Friends, 071869
In a homeowners association's challenging the trial court's validation of the City's plan to finance road improvement projects through a public benefit corporation and pay the debt from revenues held in special funds, the trial court's judgment is: 1) affirmed in part where the overall financing scheme is valid; but 2) reversed in part where the City cannot use gas tax revenues as part of the financing.
