Contreras v. Dowling, 142646

In an action brought by a lawyer appealing the trial court's denial of his special motion to strike the complaint filed against him by his former client, pursuant Code Civ. Proc. section 425.16, in an underlying landlord-tenant dispute, the trial court's order is vacated where the court erred in denying the special motion to strike, because the cause of action against the lawyer arises out of protected activity, as the only actions the lawyer himself is alleged to have taken are all communicative acts by an attorney representing clients in pending or threatened litigation.
