California Court of Appeal

People v. Padilla, 265614

In a habeas corpus action challenging petitioner's sentence to life without possibility of parole for the murder of his mother, committed when he was sixteen years old, the trial court's reimposition of petitioner's sentence is reversed and remanded where Montgomery v. Louisiana, 136 S. Ct. 718 (2016), applies the rule barring life without possibility of parole sentences for minors announced in Miller v. Alabama, 132 S. Ct. 2455 (2012), retroactively to state collateral review proceedings.
